  Although there are no federal laws that ban gambling in the United States, each state, including New York, can prohibit or approve gambling on its own terms. Gambling in New York has a long history, from horse racing and lotteries to casinos. Many bills have been passed in New York altering gambling laws over the years. In 2010, gambling does take place in New York, but certain rules and restrictions apply.
  Early History
  The first official ban of gambling in New York took place in 1821, as part of the Second Constitution of the State of New York. The new ban stated that all gambling, or lotteries, would no longer be authorized, except for “lotteries already provided by the state.” In 1864, all lotteries were banned, and in 1894 the Fourth Constitution of the State of New York banned the sale of all lottery tickets, book making or any other form of gambling.
  1900s
  On November 7th, 1939, the New York State Constitution was amended to allow pari-mutuel horse race betting. On November 5th, 1957, another amendment legalized bingo games by certain organizations, if they were regulated by the state and supervised by local government. Nine years later, an amendment to the provision allowed the sale of lottery tickets to support education within the state. In 1975, the provision was once again amended, allowing certain games of chance to be organized by religious and non-profit organizations.
  Horse Racing
  The New York State Racing and Wagering Board was established by the State Legislature in 1973, which put the functions of other existing horse racing commissions under one centralized authority. Before 1973, several commissions were responsible for the regulation and overview of legalized horse racing and the lottery. The State Racing Commission, established in 1895, was the oldest commission to be merged into the new State Racing and Wagering Board. The first permanent member of the State Racing and Wagering Board to be appointed by Governor Nelson Rockefeller was Joseph H. Boyd Jr. on June 30th, 1973.
  Casinos
  Class III Indian casinos became legal in New York on April 16th, 1993. Class III casinos, which allow gambling against the casino, featured such games as craps, blackjack and slot machines. The Oneida Tribe opened their first casino on June 20th, 1993. The Saint Regis Mohawk Tribe opened their casino on April 10th, 1999. The Seneca Tribe debuted their first casino on December 31st, 2002, their second on May 1st, 2004 and their third on July 3rd, 2007.
  Advertising
  Prior to 1999, it was a criminal offense to advertise any form of gambling in New York–except for Indian-run casinos or lotteries–on television or radio. However, a 1999 Supreme Court decision changed that. Under the Supreme Court ruling, the advertising of private casinos, Indian-run or not, would be legal in states that allowed it.
